Pharus di Giovanni Dragone END-USER LICENCE AGREEMENT IMPORTANT - READ CAREFULLY: This Pharus di Giovanni Dragone End-User Licence Agreement is a legal agreement between you (either an individual or a single entity) and Pharus di Giovanni Dragone for the Pharus di Giovanni Dragone software product Pharus 3D Builder v.0.8 beta (the "Software"). By installing, copying or otherwise using the Software, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to the terms and conditions of this Agreement, do not install, copy or otherwise use the Software. 1. LICENSE. Subject to the provisions contained herein, Pharus di Giovanni Dragone grants to you a non-exclusive, non transferable license to use the Software free of charge for your own purposes only, and not those of any third party. You may use the Software on any single computer or copy the Software for archival purposes, provided any copy must contain all of the original Software's proprietary notices. 2. PROVIDED "AS IS". Pharus di Giovanni Dragone makes no representations about the suitability of the software or about any content or information made accessible by the software, for any purpose. The software is provided 'as is' without express or implied warranties, including warranties of merchantability and of fitness for a particular purpose or noninfringement of third party rights. This software is provided gratuitously and accordingly, Pharus di Giovanni Dragone shall not be liable under any theory or any damages suffered by you or any user of the software. Pharus di Giovanni Dragone does not guarantee support or updates of this software. 3. LIMITATIONS. You may not: - permit other individuals to use the Software except under the terms listed above; - modify or create derivative works based on the Software or any parts of Software; - make any form of distribution to the public of the Software, in whole or in part, or of copies thereof; - copy the Software other than as specified above; - rent, lease, grant a security interest in, or otherwise transfer rights to the Software; - assign, transfer, sell, lease, rent, charge or otherwise deal in or encumber the Software or use the Software on behalf of any third party, or make available the same to any third party without the prior written consent of Pharus di Giovanni Dragone; 4. TITLE. Title and ownership of all proprietary rights in the Software, including any copyright, patent, trade secret, trademark, trade name or other intellectual property right, will at all times remain the property of Pharus di Giovanni Dragone You agree not to remove or obliterate any copyright, trademark or proprietary rights notices of Pharus di Giovanni Dragone from the Software. Title and related rights in the content accessed through the Software is the property of the applicable content owner and may be protected by applicable law. This license gives you no rights to such content. If you receive your first copy of the Software electronically and a second copy on media, the second copy may be used only for backup and archival purposes. 5. LIMITATION OF LIABILITY. Pharus di Giovanni Dragoneshall not be liable for 1.Indirect, special, incidental, or consequential damages of any character whether arising in tort, contract or otherwise, even if Pharus di Giovanni Dragone has been informed of the possibility of such damages, or 2.For any claim by any other party. Because some states do not allow for the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply. 3. Pharus di Giovanni Dragone concedes no rights or warranties with regard to the use of any objects, names, trademarks, service marks or works of authorship depicted in the Software. 6. TERMINATION. This License will terminate automatically if you fail to comply with the limitations described above. On termination, you must destroy all copies of the software. The obligations of you and Pharus di Giovanni Dragone under Sections 2 ("Provided 'As Is'"), 4 ("Title"), 5 ("Limitation of Liability"), 6 ("Termination") and 7 ("General Provisions") here of will survive termination of this Agreement and will continue in full force and effect thereafter. 7. GENERAL PROVISIONS. This Agreement shall be governed by and interpreted under the laws of the State of Italy, without regard to conflicts of provisions. If any provision of this Agreement is held invalid or unenforceable for any reason, the parties agree that such invalidity will not affect the validity of the remaining provisions of this Agreement, and further agree to substitute for the invalid provision a valid provision which most closely approximates the intent and economic effect of the invalid provision. This Agreement constitutes the entire agreement between you and Pharus di Giovanni Dragone and supersedes any prior agreement, whether oral or written, relating to the subject matter of this Agreement. The section headings in this Agreement are solely for convenience and will not be considered in its interpretation. Any infrangement will be prosecuted according to the law.
